Terms of Service

Please read these Terms of Service ("Terms") carefully before using [SVG Design for Cricut Space] (the "Application") operated by Pollux Bilişim Yazılım Teknolojileri San. Ve Tic. Ltd. Şti. ("we," "our," or "us").
By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.
1. Acceptance of Terms
By accessing or using the Application, you confirm that you are at least 13 years of age (or 16 in the European Economic Area) and have the legal capacity to enter into these Terms. If you are using the Application on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. License and Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on your personal mobile device for personal, non-commercial purposes, subject to these Terms.
You agree not to:
• Use the Application for any unlawful or unauthorized purpose.
• Modify, adapt, reverse engineer, decompile, or disassemble the Application.
• Reproduce, distribute, or create derivative works based on the Application.
• Remove any copyright, trademark, or proprietary notices from the Application.
• Use the Application in any manner that could damage, disable, or impair the Application or interfere with any other party's use.
• Use any automated means to access or collect data from the Application.
3. Subscriptions and In-App Purchases
The Application may offer subscription plans and in-app purchases. By purchasing a subscription, you agree to the following:
• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable subscription rate.
• You can manage and cancel your subscriptions through your device's account settings (App Store or Google Play Store).
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.
• Refund requests are subject to the policies of Apple App Store or Google Play Store.
4. Intellectual Property
All rights, title, and interest in and to the Application, including all content, features, functionality, designs, graphics, logos, trademarks, and software, are owned by or licensed to Pollux Bilişim Yazılım Teknolojileri San. Ve Tic. Ltd. Şti.. These are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, modify, distribute, display, perform, or use any of our intellectual property without our prior written consent.
5. User Content
You retain ownership of any content you create using the Application. By creating content through the Application, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the purpose of operating and improving the Application.
You are solely responsible for the content you create and must ensure it does not violate any third-party rights or applicable laws.
6. Copyright Protection
We respect the intellectual property rights of others. If you believe that any content accessible through the Application infringes your copyright, please notify us at mak@polluxstudios.com with the following information:
• A description of the copyrighted work you claim has been infringed.
• A description of where the infringing material is located within the Application.
• Your contact information (name, address, email, and phone number).
• A statement that you have a good faith belief that the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.
7. Third-Party Links and Services
The Application may contain links to third-party websites, services, or resources. We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your interaction with third-party services is governed by their respective terms and policies.
8. Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Application at your own risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POLLUX BILIŞIM YAZILIM TEKNOLOJILERI SAN. VE TIC. LTD. ŞTI. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
• Your access to or use of (or inability to access or use) the Application.
• Any conduct or content of any third party on the Application.
• Any content obtained from the Application.
• Unauthorized access, use, or alteration of your content or data.
Our total liability to you for all claims arising from or related to these Terms or the Application shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Pollux Bilişim Yazılım Teknolojileri San. Ve Tic. Ltd. Şti., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Application, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We may terminate or suspend your access to the Application immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Application will cease immediately.
All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law provisions. Any disputes arising from these Terms or the Application shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of these Terms and, where appropriate, through the Application. Your continued use of the Application after such changes constitutes your acceptance of the new Terms.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
